ACCEPTABLE USE POLICY

Your use of our site means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our terms of website use HERE.

Prohibited uses

You may use our site only for lawful purposes. You may not use our site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (as detailed below).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our terms of website use.
  • Not to access without authority, interfere with, damage or disrupt:
    • any part of our site;
    • any equipment or network on which our site is stored;
    • any software used in the provision of our site; or
    • any equipment or network or software owned or used by any third party.

Interactive services

We may from time to time provide interactive services on our site, including, without limitation messaging services (interactive services).

We will do our best to assess any possible risks for users from third parties when they use any such interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

Content standards

These content standards apply to any and all material which you contribute to our site (contributions), and to any interactive services associated with it.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

  • Contain any material which is defamatory of any person.
  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material or be pornographic.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trade mark of any other person.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Amount to bullying or internet trolling.
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Seek to exploit or mislead any other person particularly those under the age of 18.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
  • Be used for commercial purposes.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Changes to the acceptable use policy

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.

1. The prize draw (the "Prize Draw") is open to people resident in the UK aged 16 and over who complete the survey.

2. Employees or agencies of Gfinity PLC, its group companies or their family members, or anyone else connected with the Prize Draw may not enter the Prize Draw.

3. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.

4. By submitting your personal information you agree to receive emails from Gfinity PLC containing offers and developments that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.

5. To enter the Prize Draw you must complete the survey and submit your name and email address. No purchase is necessary. If you have any questions about how to enter or in connection with the Prize Draw, please e-mail us at commercial@gfinity.net with "Gfinity Elite Series Season 4 Audience Questionnaire" in the subject line.

6. Only one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

7. Gfinity PLC accepts no responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by Gfinity PLC.

8. The opening date of the prize draw is 12:00pm on 14th December. The closing date of the Prize Draw is 11:59pm on 20th December. Entries received outside this time period will not be considered.

9. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process. The draw will take place on the 4th January 2018.

10. The winner will receive a Sony Playstation 4.

11. Gfinity PLC accepts no responsibility for any costs associated with the prize and not specifically included in the prize.

12. The winner will be notified by email on or within 3 days of the 4th January 2019. and must provide a postal address to claim their prize. If a winner does not respond to Gfinity PLC within 7 days of being notified by Gfinity PLC, then the winner's prize will be forfeited and Gfinity PLC shall be entitled to select another winner in accordance with the process described above (and that winner will have to respond to notification of their win within 7 days or else they will also forfeit their prize). If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner's prize will be forfeited and Gfinity PLC shall be entitled to select another winner.

13. The prize will be sent to the winner via DHL by registered post.

14. The name and county of the winner can be obtained after 4th January 2019 by sending a stamped addressed envelope to the following address: Gfinity PLC, 35 New Bridge Street, London, EC4V 6BW.

15. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.

16. Gfinity PLC retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.

17. The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on Gfinity PLC's reasonable request. The winner consents to the use by Gfinity PLC and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner's voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by Gfinity PLC and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.

18. Gfinity PLC shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here, and in accordance with data protection legislation. By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined in point 14 above.

19. Gfinity PLC accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. Gfinity PLC further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw. Nothing in these Terms and Conditions shall exclude the liability of Gfinity PLC for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.

20. Gfinity PLC reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of Gfinity PLC in all matters under its control is final and binding and no correspondence will be entered into.

21. Gfinity PLC shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

22. The Prize Draw will be governed by English law and entrants to the Prize Draw submit to the exclusive jurisdiction of the English courts.
